European Regulation (EC) No1272/2008 on classification, labelling and packaging of substances and mixtures came into force on the 20th January 2009 in all European Union (EU) Member States, including the United Kingdom. Post-Brexit, the EU CLP Regulation as amended, is retained in GB law. This means that Great Britain continues to adopt the regulations independently of the European Union.
CLP requires all importers, manufacturers, and downstream users to classify, label and package substances and mixtures adequately before they can be placed on the market. As part of the regulations all substances and mixtures that feature hazardous properties must be correctly identified. To comply with this companies must determine the classification of their product. Once classified, any risks identified need to be communicated to your customer via the labelling of the products. Labelling involves using pre-determined hazard and precautionary statements alongside pictograms and other packaging requirements such as tactile warnings of danger to communicate all risks clearly and effectively. Finally, Safety Data Sheets (SDS) are required under Regulation (EC) No 1907/2006 (REACH) to convey CLP information about the product. The Safety Data sheet must follow the internationally agreed 16 secti0on standard and supplied in the official language of the member state where the product is being placed on the market.
In 2017 a new annex was added to the CLP regulations which requires companies selling hazardous substances/mixtures to submit harmonised information on mixtures that are placed on the market. This information must be submitted via the central ECHA poison centre notification portal.
